Its the same way with cyber brain hacking. Crimes of that nature can range anywhere from simple spying, to data theft, and even murder. You can even mess with a person's sense of reality if you have the right skills.

And I never said that this wasn't a problem. Only that the source was most likely not cybernetic in origin. Any breach of a person's mind regardless of how it was caused is a crime and should be dealt with accordingly.
